Terms of Use

These Terms of Use ("Terms") govern your use of the tradumacos application ("the App"), developed by Doruk Saraçoğlu ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, subject to the Apple Media Services Terms and Conditions and these Terms.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse-engineer, decompile, or disassemble the App
  • Remove, alter, or obscure any copyright or proprietary notices
  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App's systems or infrastructure

2. Free and Premium Plans

2.1 Free Plan

The App offers a free tier with the following limitations:

  • Maximum 30 segments per imported file
  • One LLM (AI translation) provider at a time
  • Two export formats: Translated DOCX and Bilingual Text
  • Translation Memory, Glossary, QA checks, batch operations, and pre-translate features are not available

The free tier is provided without charge and without time limitation. We reserve the right to modify the free tier's feature set at any time.

2.2 Premium Subscription

The Premium subscription unlocks all features of the App, including unlimited segments, all LLM providers, all export formats, Translation Memory automation, glossary management, QA checks, batch operations, and AI pre-translate.

Subscription details:

  • Billing: Monthly, auto-renewable
  • Payment: Processed by Apple through the App Store
  • Cancellation: You may cancel at any time via App Store → Account → Subscriptions. Access continues until the end of the current billing period.
  • Price changes: Apple will notify you in advance of any price changes. Continued use after a price change constitutes acceptance of the new price.
  • Refunds: Governed by Apple's refund policy. Contact Apple Support for refund requests.

3. Third-Party Services

3.1 AI Translation Providers

The App allows you to connect to third-party AI translation services (OpenAI, Anthropic, Google, Azure, DeepL, or self-hosted models). Your use of these services is subject to the respective provider's terms of service and privacy policy. You are responsible for:

  • Obtaining and maintaining valid API credentials
  • Complying with each provider's usage policies and rate limits
  • Any charges incurred from the provider for API usage
  • Reviewing the provider's data handling practices

We are not responsible for the availability, accuracy, or reliability of third-party AI translation services, nor for any costs, damages, or losses arising from their use.

3.2 Apple Services

The App is distributed through the Mac App Store and uses Apple's StoreKit for in-app purchases. Your use of these Apple services is governed by Apple's terms and conditions.

4. Your Content

"Your Content" refers to any documents, translations, glossaries, translation memories, notes, and other data you create, import, or manage through the App.

  • Ownership: You retain all rights to Your Content. We claim no ownership of or rights to your translations, documents, or related data.
  • Storage: Your Content is stored locally on your device. We do not have access to it.
  • Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of Your Content.
  • Backup: You are responsible for maintaining backups of Your Content. We are not responsible for any data loss.

5. Intellectual Property

The App, including its design, code, features, documentation, and trademarks, is owned by Doruk Saraçoğlu and is protected by copyright and intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

6. Translation Accuracy

The App provides tools to assist with translation, including AI-powered suggestions, Translation Memory matches, and quality assurance checks. However:

  • AI translations are generated by third-party language models and may contain errors, inaccuracies, or inappropriate content
  • Translation Memory matches are based on similarity to previously translated content and may not be contextually appropriate
  • QA checks are automated heuristics and do not guarantee error-free translations

You are solely responsible for reviewing, verifying, and approving all translations before use. We do not warrant the accuracy, completeness, or suitability of any translation produced with the assistance of the App.

7. Confidential Content

If you translate confidential, sensitive, or legally privileged documents:

  • Be aware that using AI translation sends your source text to third-party servers operated by the selected provider
  • Consider using the "Local LLM" option (e.g., Ollama) for sensitive content — all processing stays on your machine
  • Consider disabling AI features entirely and translating manually for the most sensitive content
  • Review each provider's data retention and processing policies before transmitting confidential text

We are not responsible for any breach of confidentiality that results from your decision to send content to third-party AI providers.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or free of harmful components
  • Any translations or suggestions will be accurate or suitable for your purposes
  • Third-party services integrated with the App will be available or function correctly
  • The App will be compatible with future macOS versions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DORUK SARAÇOĞLU BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Translation errors or inaccuracies
  • Unauthorized access to or disclosure of your content through third-party services
  • Service interruptions or data loss
  • Charges incurred from third-party API providers

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP'S PREMIUM SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Doruk Saraçoğlu from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your Content
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your use of third-party AI translation services through the App

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

For material changes, we will make reasonable efforts to provide notice through the App or on our website.

12. Termination

You may stop using the App at any time by uninstalling it from your device.

We may terminate or suspend your access to the App if you violate these Terms. Upon termination, your license to use the App ceases immediately. Your Content remains on your device and is not affected by termination of the license.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

14. Apple-Specific Terms

The following additional terms apply as required by Apple:

  • Acknowledgment: These Terms are between you and Doruk Saraçoğlu, not Apple. Doruk Saraçoğlu is solely responsible for the App and its content.
  • Scope of License: The license granted is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  • Maintenance and Support: Doruk Saraçoğlu is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support.
  • Warranty: Doruk Saraçoğlu is solely responsible for any product warranties. In the event of a warranty failure, you may notify Apple for a refund of the purchase price (if applicable). Apple has no other warranty obligation.
  • Product Claims: Doruk Saraçoğlu is responsible for addressing any user or third-party claims relating to the App, including product liability claims, legal compliance claims, and intellectual property infringement claims.
  • Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App, and supersede any prior agreements.
